Fully aware of that.However, you need to remember that Nullsoft is a subsidiary of AOL
We don't know the details of his contract with AOL and I guess we never will. By looking at the licensing given with the software ( whether legally binding or not is later issue with court if one ever get sued ), it's GPLed.depending on Justin Frankels contract he may or may not own that software.
Most US district courts will upheld the licensing WITH the software instead of whatever licensing later issued ( directly or indirectly to involved parties ). One could only agree to the disclosed term with the software code.
